This Privacy Notice (“Notice”) describes how Amsive, LLC, including its subsidiaries and affiliates (collectively “Amsive” “we” or “us”), collect, use and store personal information as a data controller related to:

  • the use of the Amsive.com website, or any other websites owned and operated by Amsive (“website”)
  • our past, current, or prospective customers (collectively, “customers”), including personal information collected about our points of contact at our customers’ businesses
  • individuals who communicate with us
  • individuals who use our products and services (“Services”).

This Notice is intended to describe our overall privacy and data security practices. In the event that this Notice does not cover a data processing activity, we may provide an additional notice related to that activity prior to collecting personal information from you.

What does this Privacy Notice Cover?

Before we share more about our privacy practices, we want to make sure to describe what this Notice will not cover. Please note, this Notice does not cover:

  • Data which may be available to customers through the use of our Services or data we may receive when we act as a data processor to our customers. Amsive’s Services are primarily that of a data processor, which means we act on behalf of our customers when we process their data, including when we provide direct mail, digital media, SEO, social media, data intelligence and analytics services to our customers. As such our customers control the data that we process on their behalf and how it is used. If you are a consumer of an organization that uses our Services and you have questions or concerns about the personal information that organization controls about you, please direct your request to that organization. Amsive cannot respond directly to your request.
  • Links to other websites (such as through an advertisement, service, or content link), which is governed by the privacy notice of the third-party operator of that website. Amsive is not responsible for the content of those third-party websites. We encourage you to look for and review the privacy notices and statements of each and every website that you visit through a link or advertisement on Amsive.com.

“Personal information” as used in this privacy notice shall mean any information that identifies, relates to, describes, or is reasonably capable of being associated or linked, directly or indirectly, to an individual. Personal information shall include similar terms under applicable privacy laws, such as “personal data” and “personal information.”

Personal Information We Collect About You

We collect personal information directly from individuals as they interact with us (such as when you contact us about our Services), automatically from individuals’ devices, (such as when you visit our Websites), and from third parties (such as through social media). The personal information we collect about you depends on how you engage with us, as described in more detail below.

Personal Information Collected Directly From You

You may provide us with personal information directly through your interactions with us for the following purposes:

  • Create an Account: When you create an account with, or when you update your information on your account, we may collect your name, email address, phone number, business, and job title directly from you.
  • Communicate with You: To communicate with you about your use of our Services or updates regarding our Services, respond to your inquiries, and provide customer service, we may collect your name, email address, phone number, and information about your inquiry or request directly from you.
  • Providing Services: In order to provide our Services, operate our website, troubleshoot bugs and provide technical support, we may collect name, email address, and phone number directly from you.
  • Marketing, Advertising, and Promotions: To deliver relevant ads and to evaluate the effectiveness of our marketing and advertising campaigns, to send you newsletters, offers or other information about products and Services we offer, to contact you about our Services or information we think may be relevant to you, and to administer promotions, we may collect name, email address, phone number, business, and job title directly from you. 
  • Analyzing and Improving our Products and Services: to better understand how our customers and visitors use our Services and websites, to improve our websites, Services and business operations, to develop new products and services, to conduct surveys, and for research and analysis purposes, we may collect your insights and opinions, or name and email address directly from you.
  • Personalizing Content and Experiences: to tailor content we send or display on our websites and Services and to otherwise personalize your experiences, we may collect name, email address, phone number, location, industry, company name, and job title directly from you.
  • Processing Transactions: To fulfill your orders or process payments, we may collect your name, billing address, zip code, email address, phone number, company, transaction amount, and other information related to the Services.

Personal Information Collected Automatically

We also collect personal information about how you use our Services automatically from your device(s) or browser for the following purposes:

  • Communicate with You: To communicate with you about your use of our Services or updates regarding our Services, respond to your inquiries, and provide customer service, we may collect your IP address from your device(s).
  • Providing Services: In order to provide our Services, operate our website, troubleshoot bugs and provide technical support, we may collect IP address, log information (time/date of visit, pages interacted with), device information, browser information, or location information automatically from your device(s).
  • Marketing, Targeted Advertising and Promotions: To deliver relevant ads and to evaluate the effectiveness of our marketing and advertising campaigns, to send you newsletters, offers or other information about products and Services we offer, to contact you about our Services or information we think may be relevant to you, and to administer promotions, we may collect IP address, browser type, browser version, the pages of our website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, type of mobile device you use, your device unique ID, the IP address of your device, your mobile operating system, and other diagnostic data automatically from your device(s).
  • Analyzing and Improving our Products and Services: to better understand how our customers and visitors use our Services and websites, to improve our websites, Services and business operations, to develop new products and services, to conduct surveys, and for research and analysis purposes, we may collect IP addresses automatically from your device(s).
  • Processing Transactions (Payment Processing): To process payments, we utilize a third party payment processor who may collect IP address, device information, and browser information automatically from your device(s).

Personal Information We Collect From Third Parties

Third parties under contract with Amsive may use Cookies or Web Beacons to collect Personal Information about your usage of Amsive’s website, and this information may be used by Amsive to tailor the advertising you may see on websites within the networks of these third parties. This Personal Information is anonymous and does not contain any personal information about you. These third parties may collect this information, on our behalf, to help Amsive target our advertising on these third party websites.

  • Marketing and Targeted Advertising and Promotions: To deliver relevant ads and to evaluate the effectiveness of our marketing and advertising campaigns, or to contact you about our Services or information we think may be relevant to you, we may collect IP address, company, industry, company contact information, and location information from third party partners.
  • Analyzing and Improving our Products and Services: to better understand how our customers and visitors use our Services and websites, to improve our websites, Services and business operations, to develop new products and services, to conduct surveys, and for research and analysis purposes, we may collect your opinions and survey responses from third party partners.
  • Personalizing Content and Experiences: to tailor content we send or display on our websites and Services, to offer location-based customization and personalization, and to otherwise personalize your experiences, we may collect IP address, location information, information about sites visited and actions taken from third party partners.
  • Processing Transactions (Payment Processing): To process payments, we utilize a third party payment processor that collects credit card information, billing address, zip code, and transaction information (transaction time/date, transaction ID).

Other Ways We May Use Personal Information We Collect

We may use any personal information we collect for the following business purposes:

  • Protecting our Business: to protect and secure our business, systems, the Services and our websites, to investigate, prevent, detect and respond to fraud, unauthorized access, or other potential threats to the rights and safety of any individual or third party, or other unauthorized activities or misconduct.
  • Defending Legal Rights: to manage and respond to actual and potential legal disputes and claims, and to otherwise establish, defend, or protect rights or interests, including in the context of anticipated or actual litigation.
  • Auditing, Reporting, Governance and Internal Operations: to conduct our business, including fulfilling our financial, tax and accounting obligations, such as audits, assessments, privacy, security, and financial controls, accounting, record keeping and legal functions, any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy, or restructuring of all or part of our business.
  • Complying with Legal Obligations: to comply with the law, our legal obligations and legal processes (such as warrants, subpoenas, court orders, and regulatory or law enforcement requests).

How We Use Cookies and Other Tracking Technologies

Amsive uses tracking technologies, such as cookies, web beacons, and pixels as described in this Notice. This section gives you more details about the information we automatically collect from your device(s) and browser(s) when you engage with us online or click on a link in an email. First, we want to help you understand the different tracking technologies that Amsive uses:

  • Cookies – a “cookie” is a small text file that websites send to your computer, device, or other internet-connected tool you are using that contains data used by the website for its business purposes. Amsive’s website uses cookies for Amsive’s own business purposes. 
  • Web Beacons – a “web beacon” or “pixel” is a tag used on a web browser or HTML email that records your activities when viewing the web page or email it is placed on. Amsive uses web beacons to assist us in monitoring and improving our Services and communications.   

Cookies are classified by their purpose:

  • Essential – These cookies are required for the website to function. You cannot disable these.
  • Targeted Advertising – Used to deliver advertising that is more relevant to you and your interests. May also be used to limit the number of times you see an advertisement and measure the effectiveness of advertising campaigns.
  • Personalization – Allow the website to remember choices you make (such as your username, language, or the region you are in) and provide enhanced, more personal features. For example, a website may provide you with local weather reports or traffic news by storing data about your general location.
  • Analytics – Help the us understand how its website performs, how visitors interact with the site, and whether there may be technical issues.

How We Use Cookies, Web Beacons and Similar Technologies

The information collected by cookies (i) helps us dynamically generate advertising and content on webpages or in newsletters, and (ii) allows us to statistically monitor (A) how many people are using our website and selected sponsors’ and advertisers’ websites, (B) who and how many people open our emails, and (C) for what purposes these actions are being taken. We may use cookie information to target certain advertisements to your browser or to determine the popularity of certain content or advertisements. Cookies are also used to facilitate a user’s log-in, as navigation aids and as session timers. Most browser software can be set to reject all cookies. Most browsers offer instructions on how to reset the browser to reject cookies in the “Help” section of the toolbar. If you reject our cookies, certain functions and conveniences of our website may not work properly but you do not have to accept our cookies in order to productively use our website. 

We also may use web beacons to collect information about your use of our website and the websites of selected sponsors and advertisers, and your use of special promotions or newsletters. The information collected by web beacons allows us to statistically monitor (i) how many people are using our website and selected sponsors’ and advertisers’ websites, (ii) how many people open our emails, and (iii) for what purposes these actions are being taken. Our web beacons are not used to track your activity outside of our website or those of our sponsors. 

You may opt out of non-essential cookies by choosing to turn off cookies through the use of our Cookie Banner when you first visit our website, or through the use of our Cookie Preferences link available on the footer of our homepage. Please be aware that some features of our websites may not function properly or be available when you turn off non-essential cookies. Please note, that your cookie preferences do not save from one session to the next.

Third Party Cookies

Third parties under contract with Amsive may use cookies or web beacons to collect personal information about your usage of Amsive’s website, and this information may be used by Amsive to tailor the advertising you may see on websites within the networks of these third parties. This information is aggregated with information we collect about other individuals who use our website and cannot be re-identified. These third parties may collect this information, on our behalf, to help Amsive target our advertising on these third party websites.

Does Amsive Use Targeted Advertising

Amsive uses third party tracking technologies, to analyze visitor behavior, identify visitors, and serve relevant re-targeted advertisements. When you visit our website, your IP address and the actions you take will be processed by our third parties. This process helps us understand who is using our site by enriching IP addresses with information about your company or your industry code. To do this, our third party tracking technologies search your IP address against a database of known companies. We may use this information to identify email addresses of individuals at your company to contact about our relevant products or services. 

You may opt out of targeted advertising (also known as behavioral advertising) by choosing turning off Targeted Advertising cookies through the use of our Cookie Banner when you first visit our website, or through the use of our Cookie Preferences link available on the footer of our homepage.

Third Party Ad Servers

Sponsors, advertisers or other third parties on Amsive may use their own cookies, web beacons or other online tracking technologies in the banner advertisements served on Amsive and in emails, special promotions or newsletters we send you. Some of these third parties use companies other than Amsive to serve their ads and to monitor users’ responses to ads, and these companies (“Ad Servers”) may also collect information through the use of cookies or web beacons on our website. In certain situations, information collection may be facilitated by momentarily directing your browser to the website of an Ad Server or other third party acting on behalf of the sponsor, advertiser or vendor before re-directing your browser to its selected destination (e.g., back to Amsive to show the ad, or to the advertiser’s website); this re-direction process will not be apparent to you. We do not control these third parties’ use of cookies or web beacons, or how they manage the information they gather through them. You should review the privacy notices of other websites you visit or link to from our website to understand how these other websites use cookies and how they use the information they collect through the use of cookies or web beacons on their own websites. Certain Ad Servers allow you to prevent them from collecting data through the use of cookies. In order to do so, you must opt-out of such data collection with each individual website. You may also be able to opt-out of cookies for participating Ad Servers through the Network Advertising Initiative gateway opt-out website www.networkadvertising.org.

Do Not Track Signals

Some browsers allow you to turn on Do Not Track signals (DNTs), which sends signals to the websites you visit telling those sites that you do not wish to have your online activities tracked. Our website does not currently respond to DNTs received from web browsers.

How We Share Your Information

We share your personal information with third parties for our legitimate business purposes, including:

  • With service providers and vendors that provide services for us or on our behalf, including, without limitation, SPAM filtering and prevention efforts;
  • With select partners, service providers, and vendors in connection with the provision of our Services;
  • With advertisers for our targeted advertising;
  • To comply with a legal or regulatory obligation, protect and defend Amsive’s rights or property, protect the safety of our customers and the public, and protect against legal liability;
  • In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by a third party;
  • Between and among Amsive’s current and future parents, subsidiaries, affiliates, and other companies under common control and ownership; and
  • With your consent and at your direction.

User Generated Content

As a service to our users, Amsive may feature message boards, chat rooms and other public forums where users with similar interests can share information and support one another or where users can post questions for others to answer. We also may offer online discussions moderated by others.

Any information shared (including personal information) that you reveal in a chat room, message board, or online discussion is by design open to the public and is not a private, secure service. You should think carefully before disclosing any personal information in any public forum. What you have written may be seen by, disclosed to or collected by third parties and may be used by others in ways we are unable to control or predict, including being used to contact you for unauthorized purposes. As with any public forum on any website, this information may also appear in third-party search engines like Google, Yahoo, MSN etc.

De-Identified And Aggregate Information

Amsive may de-identify and aggregate data for its business purposes, including but not limited to, to improve the products and features of its Services, to maintain the security and integrity of its systems, for analytics, and other legitimate business purposes. “De-identified Data” means information that cannot reasonably be used to infer information about, or otherwise be linked to a particular data subject.  Where we process De-identified Data, we commit to maintain and use the information in de-identified form and not attempt to reidentify the information, except where permitted by law. Amsive may disclose De-identified Data to third who commit themselves to maintaining the De-identified Data in de-identified form and not attempt to re-identify the data for any business purpose. Amsive may also provide aggregate data to third parties. For example, we might inform third parties regarding the number of users of our website and the activities they conduct while on our website.

Direct Marketing Preferences

If you choose to register with Amsive, and at various times as you use Amsive, you will be given the option of receiving recurring informational/promotional newsletters via email from Amsive. At the time you sign up for our email newsletters or any time thereafter, you can choose to Opt-In to receiving additional promotional emails from Amsive. In order to subscribe to Amsive newsletters via email, we need your contact information, such as name and email address. You can unsubscribe from the newsletters by simply clicking on the “unsubscribe” link at the bottom of any email newsletter. Amsive will use its commercially reasonable efforts to unsubscribe you from that newsletter within two to three business days. You may also unsubscribe or change any of your email preferences by clicking on the applicable links in your email newsletter or by changing your profile within Amsive. Amsive will use its commercially reasonable efforts to unsubscribe you from that newsletter within two to three business days. In some cases, when you click on a link or an advertisement on our website, in an e-mail or a newsletter, your browser may be momentarily directed to the website of a third party which, acting on behalf of Amsive, notes or “counts” your response to the e-mail or newsletter before re-directing your browser to your selected destination; this re-direction process will not be apparent to you.

Required Disclosures

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA”) requires us to tell residents of California about the personal information we collect about them in a certain way – specifically, we need to tie it back to “legal categories” of personal information that are listed in the law.  To do this, we bundled up the information we gave you above in this Notice and matched the different types of personal information we collect about you with the legal category.  To make things easier to understand, we’ve put this information in a chart that shows you five things:

  • The legal category of personal information, 
  • Examples of the types of personal information included in each legal category, 
  • The purpose for why we collect and use your personal information for each legal category
  • The business purposes for which we share your personal information and with whom, and 
  • The categories of third parties which we sell your personal information.

We’ve included these things in Annex 1 – Privacy Chart.  

Data Subject Rights and Choices

Some U.S. privacy laws require that we disclose the privacy rights that you may have regarding your personal information. We have defined the various rights below. To see which rights may apply to you, refer to the Privacy Rights Chart immediately following this subsection. 

For all personal information that we collect about you, you may have the following rights or choices that we will accommodate where your request meets legal and regulatory requirements. You may also designate an authorized agent to make a request on your behalf.

Right to access — The right for a consumer to access from a business/data controller the information or categories of information collected about a consumer, the information or categories of information shared with third parties, or the specific third parties or categories of third parties to which the information was shared; or, some combination of similar information. 

Right to correct — The right for a consumer to request that incorrect or outdated personal information be corrected but not deleted. 

Right to delete — The right for a consumer to request deletion of personal information about the consumer under certain conditions. 

Right to opt out of certain processing — The right for a consumer to restrict a business’s ability to process personal information about the consumer. For example, consumers have the right to opt out of targeted advertising and behavioral advertising.

Right to portability — The right for a consumer to request personal information about the consumer be disclosed in a common file format. 

Right to opt-out of sales — The right for a consumer to opt out of the sale of personal information about the consumer to third parties. 

Right to opt in for sensitive data processing — The right for a consumer to opt in before a business can process their sensitive data. 

Right against automated decision making — A prohibition against a business making decisions about a consumer based solely on an automated process without human input. 

Right to appeal — where a controller declines to take action regarding a consumer’s request to exercise any privacy right, the controller must allow the consumer to appeal the decision and provide instructions on how they may request an appeal.

Additional California Rights (Shine the Light Notice)

California residents have additional rights regarding disclosure of personal information to third parties for their own direct marketing purposes. We provide California residents with the option to opt-in to sharing of “personal information” as defined by California’s “Shine the Light” law with third parties, other than with our affiliates, for such third parties’ own direct marketing purposes. We do not share personal information with non-Affiliate third parties for their direct marketing purposes absent your consent. If you are a California resident, you may request information about our compliance with the Shine the Light law and/or withdraw previously given consent to sharing with non-Affiliate third parties for their direct marketing purposes by contacting using the methods in the “Contact Us” section below. Requests must include “California Marketing Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the provided e-mail address or mailing address.

Responding to Requests 

Your request will be evaluated to determine whether it meets the legal and regulatory requirements under applicable law, and does not risk compromising our other data or the personal information of other individuals. If we aren’t able to fulfil any part of your request, we will let you know in our response, as well as the reason(s) we cannot do so.

Verification

To protect your privacy and security, we will take reasonable steps to verify your identity before providing your personal information and before deleting your information. Only you or someone legally authorized to act on your behalf may make a verifiable request related to your personal information. For example, if you make a request, we will ask you to confirm your name, email address, and/or other information we in our records to verify your identity, so that we can help protect your information. 

Requests by Authorized Agents  

You may designate an authorized agent to make a request for you. If you designate an authorized agent to make a request on your behalf, we may require you to verify your identity and provide the authorized agent’s identity and contact information to us.

How We Protect Data

While Amsive has safeguards in place to prevent unauthorized access or interception, there is no absolute guarantee of security. In the event of an interception or unauthorized access, Amsive shall not be responsible for such interception or unauthorized access, or any direct, indirect, special, incidental or consequential damages (including lost profits) suffered by you, even if Amsive has previously been advised of the possibility of such damages. Amsive does not warrant, either expressly or impliedly, that the information you provide shall be free from interception or unauthorized access, and does not provide any implied warranties of merchantability and fitness for a particular purpose.

How Long We Store Data

We will only retain your personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements.  To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

We cannot (fully) comply with a request to erase or delete if we have to retain your personal information for certain purposes and for a longer period due to a statutory retention period.  After the retention period has expired, we will delete your personal information.  

Children’s Privacy

Our Services are not intended for use by anyone under the age of eighteen (18).  In accordance with the Children’s Online Privacy Protection Act (“COPPA”), we do not knowingly request or solicit personal information from anyone under the age of thirteen (13) nor will we knowingly allow anyone under the age of thirteen (13) to register with us.  In the event that we receive actual knowledge that we have collected such personal information without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is practical.  We reserve the right to request proof of age at any stage so that we can verify that minors are not using the Services. 

Changes To This Notice

We reserve the right to change this Notice prospectively effective upon the posting of the revised Notice and your use of our websites indicates your acknowledgement of the Notice posted at the time of use. However, should we update this Notice, we will post a new version online, and will notify you if the personal information processed about you will be materially different than that which was represented to you at the time it was collected. To the extent any provision of this Notice is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
